TERMS AND CONDITIONS OF ONLINE ENTRY

These Terms and Conditions

 

2.1 Use of Online Entry is restricted to persons aged 18 or over. Parents/guardians must complete Online Entry on behalf of players aged under 18, and are responsible for ensuring that the player understands and complies with these Terms and Conditions and the Competition Rules.

2.2 Coaches and other representatives of players may complete Online Entry on behalf of players, provided the player (or the player’s parent/guardian, if under 18) has authorised them to do so, and has been made aware of and agrees to these Terms and Conditions and the Competition Rules.

2.3 Parents and coaches/representatives (Representatives) must agree to these Terms and Conditions and the Competition Rules, before submitting an entry on the player’s behalf.

 

3 Acceptance of your Entry

3.1 On receipt of your entry (which must be received before the deadline specified on the https://alxchangeit.square.site/ Website) the player, will receive an email acknowledgement, which may be considered payment of entry to the event. However, acceptance of your entry remains subject to (a) approval of it by the Organising Committee of the relevant competition in accordance with the ALXCHANGE IT! LTD Competition Regulations and (b) receipt of the full amount of the Entry Fee as set out in 6 below.

3.2 Please consider your entry automatically accepted unless you are contacted after placing your order between payment and event date.

4 Responsibility for Competitions
4.1 You acknowledge and agree that by providing Online Entry, ALXCHANGE IT! Ltd is merely facilitating entry to competitions. Only ALXCHANGE IT! Ltd Staged Competitions are organised and run by the ALXCHANGE IT! Ltd. ALXCHANGE IT! Ltd shall have no further obligation to you in relation to the provision, organisation or running of any Third Party Competitions, which are the sole responsibility of the person or entity organising the relevant competition (the Third Party Organiser).

5 Withdrawal

5.1 To withdraw from a tournament entered through Online Entry, you must either contact the Organiser or the Referee of the relevant competition (or their representative) using the contact details (provided on request)

5.2 Please note that once the withdrawal date for the competition as specified in the Acceptance Email (the Withdrawal Date) has passed, you will no longer be able to withdraw and must contact the Organising Committee or the Referee as set out in

5.1 above.

 

6 Payment

6.1 The entry fee for the competition is stated under the Event entry (Entry Fee). Payment of the Entry Fee must be made at the time of entry by you or by your Representative using one of payment methods specified on the ALXCHANGE IT! Ltd Website for the relevant competition. Where payment is made by Paypal the following terms also apply:

6.2 Debit/Credit Card (Square): Follow the instructions during Online Entry. On receipt of payment, Square will send the card holder an email confirming receipt of payment. Payment via Square may be subject to Square’s own terms and conditions (as advised by Square).

 

7 Refunds

7.1 Under ALXCHANGE IT! Ltd Competition Regulations you are entitled to a full refund of the Entry Fee in the following circumstances:

7.1.1 Your entry is not approved by the Organising Committee of the relevant competition (or you are accepted as a reserve and are not called upon to play); or

7.1.2 The competition is cancelled before you have started a match, subject to the player having not withdrawn prior to the decision to cancel the competition.

7.2 Notwithstanding the ALXCHANGE IT! Ltd Competition Regulations, where you withdraw from the competition prior to the Withdrawal Date you will be entitled to a refund of the Entry Fee but this will be the subject to the deduction of an administration fee of 3.4% of the Entry Fee +40p. (Refunds of the Entry Fee after the Withdrawal Date are at the discretion of the Organising Committee of the relevant competition, acting in accordance with the ALXCHANGE IT! Ltd Competition Regulations and any such discretionary refunds will also be subject to the deduction of an administration fee of 3.4% of the Entry Fee +40p). Competition Support Team November 2021 Refunds may be paid to the person who paid the Entry Fee, or the player, by cash, or the method used to pay the Entry Fee, at the discretion of the Organising Committee of the relevant competition.

7.3 ALXCHANGE IT! Ltd accepts no responsibility whatsoever for refunds due in relation to Third Party Competitions, which remain the sole responsibility of the Third Party Organiser. All enquiries about refunds for Third Party Competitions must be addressed to and resolved by the Third Party Organiser.

8 Overseas Entries

8.1 Please note that Online Entry only allows entry to UK tournaments. These terms and conditions are available in the English language only. All Entry Fees are in pounds, although the card issuer of the card used to make payment via Paypal may convert the charge into your local currency.

8.2 Whilst we will consider requests for services from outside the United Kingdom, we give no warranty, express or implied, that the ALXCHANGE IT! Ltd website or the submission of any entry using Online Entry from outside the UK complies with any applicable non-UK laws or regulations.

 

9 Player Undertaking

9.1 By submitting your entry you, the player (and your parent or guardian, if you are under 18) undertake, in accordance with clause 3.9 of the ALXCHANGE IT! Ltd Competition Regulations, that you:

9.1.1 have read, and agree to be bound by and comply with, the conditions of entry, including the application of the ALXCHANGE IT! Ltd Competition Regulations (including the ALXCHANGE IT! Ltd & Konami Code of Conduct), the Rules of Yu-Gi-Oh! the Konami Rules and the Konami Disciplinary Code (including Regulations Concerning Match Fixing, Financial Speculation and Betting);

9.1.2 acknowledge that emergency services can be contacted by staff and other team members.
9.1.3 acknowledge that you may be involved in any filming of, and publicity connected with, the competition, including video recording, media interviews, photographs, TV footage, and live streaming of matches, unless the Entry Secretary or Referee is informed otherwise in writing before the commencement of the competition;

9.1.4 consent to the ALXCHANGE IT! Ltd and/or the competition organiser using the details provided on the entry form to communicate information to you, the player, about the competition and future competitions and/or events that may be of interest to you;

9.1.5 are responsible and accountable for the conduct of your coaches, representatives, agents, medical staff, relatives, associates, entourage, and/or spectators, and undertake to ensure that each such person is made aware of and agrees to be bound by and to comply with the ALXCHANGE IT! Ltd & Konami Competition Regulations.

9.1.6 agrees to filming by the ALXCHANGE IT! Ltd Team for the purposes of player development unless the entry secretary or Referee is informed otherwise in writing before the commencement of the competition;

9.1.7 provide information relating whether the Player has any medical condition or disability which the Referee should be aware of.

10 Data Protection

10.1 We will process your personal data in accordance with the General Data Protection Regulation 2016/679 and in line with the ALXCHANGE IT! Ltd Privacy Policy. You agree that we, and the person or entity organizing the competition (including any Third Party Organiser) may use your personal data to organize and provide the competition, and for the purposes set out in the Player Undertaking above. Processing of personal data by Third Party Organisers will be subject to the fair processing information notices that those Third Party Organisers provide.

11 General

11.1 Governing Law: These terms and conditions are governed by English Law. You agree with us to submit to the exclusive jurisdiction of the English courts.

11.2 Entire Agreement: These terms and conditions, together with the information and documents referred to in them, constitute the whole agreement between you and ALXCHANGE IT! Ltd in relation to the provision of Online Entry.

11.3 Validity of Terms: Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

11.4 Contacting the ALXCHANGE IT! Ltd: If you need to contact the ALXCHANGE IT! Ltd about Online Entry, you may do so by post using the address given above or by email using this address alxchangeit@hotmail.com.

    1. These terms and conditions apply to your use of the ALXCHANGE IT! LTD's online portal (Online Entry), in addition to the LTA Online Terms and Conditions and the LTA Privacy Policy.

    2. You must also comply with Konami Competition Regulations, the Rules of Yu-Gi-Oh!, the ALXCHANGE IT! Ltd Store policies, and any additional terms of entry for the relevant competition made available to you by the competition organiser (together the Competition Rules). Players and their supporters will also be expected to support the Yu-Gi-Oh! Fair Play values Enjoy and Respect.

    3. Online Entry enables you, the player (or a person acting on your behalf) to enter ALXCHANGE IT! Ltd approved competitions online, via https://alxchangeit.square.site/ (the ALXCHANGE IT! Ltd website). A small number of LTA approved competitions are organised by the LTA (LTA Staged Competitions).

    4. Online Entry is provided by ALXCHANGE IT! Ltd, a company registered in England and Wales under company number 10187094, with its registered office at 30 Churchgate, Leicester, LE1 4AJ. VAT NO Our VAT number is 343 3846 95. References to "we", "us" and "our" should be construed as references to the ALXCHANGE IT! LTD.

Return Policy

COVID-19 Update:
Working hard to process all returns however, these are taking longer to process than normal as we prioritise the safety of our staff and customers.If you've sent an online purchase back to us for a refund, this should be processed within 21 working days of receipt to our distribution centre, you'll receive an email to confirm when this has been processed.

Overview of your right to return a product
Goodwill Returns Policy. In addition to your legal right (see below);
we offer an exchange or refund policy for purchases made online (where your 14 day right to change your mind has expired) provided the product is returned to our Returns Department within 28 days of receipt of your online order; and we offer an exchange or credit note for purchases excluding made in-store and returned in store within 28 days of purchase  

14 Day Legal Right to change your mind. For most products bought online, over the telephone, by exchange of email or by mail order (“Distance Sales”), you have the legal right to change your mind within 14 days of receiving the product and receive a refund


Returning your product because it has a fault. If your product develops a fault within 30 days of purchase, please return with proof of purchase and we’ll exchange or refund it. After 30 days but within 3 months, we’ll repair or replace the product in accordance with the terms of the Consumer Rights Act 2015.


Returning an item if you are an international customer. 
For information on how to return an item if you are an international customer. International sellers are assisted on a case-by-case basis. There may be additional charges for returns if the item arrives back to the business in condition different to sold or if the reason for return is deemed a result of customer misuse by manager in charge of store.


Returns & Refunds 


RETURN POLICY: All trading card and memorabilia products sales are final.  


APPAREL May be exchanged up to 30 days from the date of purchase. Items must be unwashed, unworn, with tags attached.


2 Days Goodwill return - If you are not satisfied with your purchase for any reason, we will happily return it to voucher within 2 days of purchase. Please note that all items must be returned in the same state/condition in which they were sold. This policy is offered at management discretion and can be withdrawn at any time. 


30 Days Statutory Refund Policy - Did your item develop a fault, that has occurred through no fault of your own? Provided it is returned with a receipt and we can verify the fault, we can offer a full refund to the original payment method, repair or replace the item, or exchange it for something else of equal value.


3 Month warranty on all items (except consumables) - Outside of the 30 day period, if your item develops a fault through no fault of your own, we will aim to repair/ replace the item. In the event that this isn't possible, we will issue a refund to the original payment method at the original sales value, provided the item is returned within 28 DAYS from the date of purchase. If your item is returned after 3 months from the date of purchase then we will refund as a credit note for the original value to spend in-store.

All faults must be verified in order to honour the warranty. 
Proof of purchase is required for all returns.
Faults due to removable batteries not covered beyond 30 days. 


The 2 Days Goodwill return does not include new items such as DIGITAL GIFT CARDS.


You do not have to return to the same store that the item was purchased in. Your warranty will be valid in any ALXCHANGE IT! LTD store.


Please note that all items that are sold as new or are factory sealed are restricted from our unwanted items returns policy, along with titles that are exclusively for online play.

When does the ALXCHANGE IT! LTD returns policy apply Online? We offer a 28 day right to a refund or exchange (subject to availability) on our products (excluding gift vouchers/gift cards*) ordered online, provided that:


the product is returned within 28 days of delivery;
you have a valid proof of purchase (which can include any of the following documents):
Online Despatch note.
the product is returned in its original condition (unopened and unused). Please note hardware or accessories purchased online may be opened for the purpose of inspection (but not used);
the product is in its original packaging and is sealed;
if you are returning a Console or Controller the serial number must match the one on your proof of purchase;
the product and/or digital content has not become mixed inseparably with other items after their purchase;
the product is complete and contains all component parts as purchased. Items purchased as part of a combined product (for example a combined hardware, games and accessories bundle) can only be returned if all items in the combined product are returned together;
the product is re-sellable;
if returning hardware, all the components (cables, memory sticks, controllers, etc.) must be returned;
the customer is the original purchaser of the product;
in respect of Microsoft Digital Credit, when returning the item;
you have a valid proof of purchase and the receipt displaying the code; and
the code has not been redeemed via Xbox Live
in our reasonable opinion, you have not behaved fraudulently nor are you engaging in any fraudulent activity.


When does the ALXCHANGE IT! LTD returns policy apply In-store?

We offer a 28 day right to an exchange (subject to availability) or credit note on our products (excluding gift vouchers/gift cards*) purchased in-store and returned in-store, provided that:
the product is returned within 28 days of purchase;
you have a valid proof of purchase which can include any of the following documents (except where you are returning an Console or Controller which require a receipt as proof of purchase):


Receipt.
Bank statement or credit card statement.
the product is returned in its original condition (unopened and unused). 

 

if you are returning a Console or Controller the serial number must match the one on your receipt;
the product and/or digital content has not become mixed inseparably with other items after their purchase;
the product is complete and contains all component parts as purchased. Items purchased as part of a combined product (for example a combined hardware and games product) can only be returned if all items in the combined product are returned together;
the product is re-sellable;
products bought in a discounted or promotional offer (including 3 for 2, hardware and software packs) if returned separately, will result in the full price being charged for other items in the offer. Your applicable exchange value or credit note value will be adjusted accordingly. This includes digital and download copies of games and movies;
if returning hardware, all the components (cables, memory sticks, controllers, etc.) must be returned;
the customer is the original purchaser of the product;
in respect of Digital Credit, when returning the item;
you have a valid proof of purchase and the receipt displaying the code; and
the code has not been redeemed via Xbox Live
in our reasonable opinion, you have not behaved fraudulently nor are you engaging in any fraudulent activity.


Gift Cards. You cannot rely on the ALXCHANGE IT! LTD returns policy for a refund or exchange of gift cards or digital codes. This will not affect your statutory rights (for example in the event the gift card is faulty).


The ALXCHANGE IT! LTD returns policy will not effect your legal rights. Please note that for the purposes of orders placed online, over the telephone, via email or mail order, our return policy is in addition to your legal 14 day right to change your mind and will not affect your legal rights (click here for more information on how to exercise your right to change your mind).


How to return your product under the ALXCHANGE IT! LTD returns policy? Items purchased in store must be returned to a store. Items purchased online must be posted back to us at the address below. Please remember to obtain Proof of postage from the Post Office.

Collection of personal data for fraud prevention. When returning your product to a store we require certain personal information in order to process your return in accordance with the GAME returns policy. All information is collected and processed in accordance with our Privacy Policy.
Who will pay the costs of return? We will pay the costs of return:
if the products, and/or digital content are faulty or misdescribed; or
if you are ending the contract because we have told you of an upcoming change to the products, and/or digital content or these terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong.


In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.


How we will refund your Online purchase. We will refund you the price you paid for the products and/or digital content (including any applicable outward delivery costs) by the method you used for payment. However, we may make deductions from the price, as described below. Please note that payments made using a physical gift card at ALXCHANGE IT! / ALPHA GAMING store will be refunded as an eVoucher, which will be emailed to you. This is for Online purchases only.
Deductions from refunds from Online purchases if you are relying on our ALXCHANGE IT! LTD returns policy:


We may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the products, if this has been caused by your handling them in a way which would not be permitted in a shop.


We may reduce your refund of the price (excluding delivery costs) where you fail to return each component part (cables, memory sticks, etc.) and to take account of the reduction in value caused by any damage or missing components.


We may reduce your refund of the price (excluding delivery costs) if you wish to return a product purchased in a discounted or promotional offer.
If we refund you the price paid before we are able

to inspect the products and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.


The maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method we offer. For example, if we offer delivery of a product within 3-5 days at one cost but you choose to have the product delivered within 24 hours at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.


When will your refund for an Online purchase be made? Your refund will be made
Immediately when returned in-store  (however please allow up to 5 working days for this to be processed) within 14 days when returned to our refund department.


International returns. For information on how to return an item if you are an international customer. International sellers are assisted on a case-by-case basis. There may be additional charges for returns if the item arrives in condition different to sold or if the reason for return deemed a result of customer misuse by manager in charge of store.
